Terms & Conditions

1. Definitions

In the Terms and Conditions the following definitions apply:

· "Terms and Conditions" means these terms and conditions.

· "Terms" means these terms and conditions.


· "Studio" means any premises hired by YOLO PILATES for the purpose of Pilates Instruction

· "Client" means any person that has completed and submitted the informed consent form and PARQ questionnaire at Yolo Pilates, and his or her registration has been accepted by Yolo Pilates.

· "Site Information" means the information contained in the pages of the Site.

References in the Terms and Conditions to the singular will include the plural and vice versa. References to the masculine gender will include references to the feminine gender. References to the feminine gender will include references to the masculine gender.

2. Governance and Applicability

If you access and use the Site, you accept and agree to be bound by and comply with these Terms. If you do not accept the Terms, do not use the Site.

The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

 2.1. General

· All products and services of Yolo Pilates and its subsidiaries and affiliates are subject to the terms and conditions of the applicable agreements governing their use.

· The Terms are to be read by you together with any terms, conditions or disclaimers provided in the pages of the Site. In the event of any conflict, the terms provided in the pages of the Site will govern.

· The information, material and content provided in the Site Information may be changed at any time without notice. Changes may be made to the Terms at any time without notice by updating this posting. You agree to review the Terms regularly and your continued access or use of the Site will mean that you agree to any changes.

3. Studio

3.1. Conduct

Members are required to follow the instructions of Yolo Pilates instructors at all times.

3.2. Dress

Clients are required to wear a form of dress appropriate to the practice of Pilates. Yolo Pilates recommend that clients wear stretch pants or shorts and a T-shirt or sports top. No zips or buttons to be work that may scratch or tear the equipment. Clients should attend sessions barefoot or, if preferred, with socks.

 3.3. Studio Opening Times

Session times at the Studio may vary from time to time, including cancellations of individual classes. Session times will be published by Yolo Pilates and will be available either at the studio or on the Website.

3.4. Timeliness

Out of consideration for instructors and clients, and also for your own safety, please be aware that if you are more than five minutes late for a class, you may not be able to take part. In this instance, Yolo Pilates reserves the right to charge you for the session.

4. Payment Terms

4.1. Payment for Products & Services

All Credit Cards will be processed in Pounds Sterling at the time of payment. Yolo Pilates is not responsible for any fees, charges, exchange rates or additional charges levied by individual financial institutions or Credit Card companies.

4.2. Gift Certificates

Details of session prices and gift certificate prices are available either Yolo Pilates or directly from the Studio.

Payments for sessions and gift certificates in any amount are non-refundable unless otherwise stated in these Terms and Conditions.

5. Refund / Cancellation Policy

5.1. Services

 5.1.1. Private Training

You can cancel or reschedule sessions but you must give the Studio 24 hours notice. Failure to cancel or reschedule a session within 24 hours of its start time will result in you being charged for the session.

You can reschedule or cancel sessions via your personal booking facility linked to from the Site or by telephoning Yolo Pilates.

If you have not already paid for the session, your account/card will be charged for the full amount of the session.

If no card/account information is present, no further sessions will be conducted until the outstanding payment is received.

Additionally, reserved time slots may be lost if payment is not made in a timely manner.

 5.1.2. Registered Programs

If you are unable to attend a program due to circumstances out of your control (determined on a case-by-case basis by our administration), we can offer you a refund if you notify us prior to your session start date. However we do charge a 30% cancellation fee. This cancellation fee may be avoided if you opt for a service credit instead of a refund. Service credits are valid for 90 days only.

If we are notified after your session begins, we can only give you a credit towards another program. This credit is nontransferable and accounts for only the sessions remaining in your program at the time you requested cancellation.

Refunds cannot be made in cash.

  5.1.3. Consulting

No refunds are available for completed consulting services.

 5.2. Products

 5.2.1. Fitness Equipment and Accessories

May be returned within 14 days for exchange only. Returns are valid only for products that have not been opened, used or damaged.

Products that are defective or damaged upon arrival may be returned immediately for exchange.

Some products may need to be shipped directly to the manufacturer. This will be stated on the product package or instruction insert. Should you be unsure if this is the case, please contact us using the information at the bottom of this page

Customers are responsible for all shipping charges on exchanges or refunds.

Refunds are only available when an equivalent replacement in unavailable and customer does not wish to exchange for another product

6. Health, Fitness, Safety and Hygiene

6.1. Health

It is the Client's responsibility to ensure that he is capable of undergoing a routine of exercises provided by any programme that he follows or session which he attends. Clients accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by instructors at Yolo Pilates at no time constitutes medical advice in substitute for advice provided by a medical professional.

Members are advised not to undertake physical activities without first seeking medical advice if they have concerns over their physical condition. Yolo Pilates reserves the right to refuse access to any Client if, in Yolo Pilates absolute discretion, it considers that the health of the individual concerned may be endangered by the use of its facilities.

Participants must inform Yolo Pilates of any changes in their health and fitness, including pregnancy, injuries or medical conditions, before undertaking any activities at the Studio. Yolo Pilates must be informed of any such changes after the initial health questionnaire is complete. It is the clients responsibility upon request to update personal health information

7. Limitation of Liability

7.1. Availability

Yolo Pilates cannot be held responsible for any particular session, instructor and/or item of pilates equipment not being available for whatever reason. Yolo Pilates reserves the right to make alterations to the sessions, instructors and/or equipment, as well as to those ancillary facilities provided to Clients, without notice and in its absolute discretion and Yolo Pilates will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion.

Yolo Pilates accepts no liability for injury to Clients on the Studio premises or outside the Studio except insofar as such loss, damage or injury is by law incapable of exclusion.

In consideration of their participation in the activities and programmes of Yolo Pilates and the use of facilities and equipment owned and/or under the control of Yolo Pilates, the Client hereby waives and releases Yolo Pilates and its instructors from any and all responsibility or liability for injuries or damages resulting from their participation in any of the activities facilitated by Yolo Pilates or use of  Studio's equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of Yolo Pilates.

7.2. Personal Belongings

Personal belongings are brought onto the studio premises at the clients own risk and the company does not accept liability for any loss or damage whatsoever to such items.

7.3. Internet E-Mail

Any unprotected E-Mail communication over the Internet is, as with communication via any other medium (e.g. cellular phones, post office mail), not confidential, subject to possible interception or loss, and is also subject to possible alteration.

 7.4. No Endorsements

No endorsement or approval of any third parties or their advice, opinions, information, products or services is expressed or implied by any Information.

 7.5. Links/Software

Links from or to web sites outside the Site are meant for convenience only. Yolo Pilates does not review, endorse, approve or control, and is not responsible for any sites linked from or to the Site, the content of those sites, the third parties named therein, or their products and services. Following links to any other site is at your sole risk and Yolo Pilates will not be responsible or liable for any damages in connection with following links. Links to downloadable software sites are for convenience only Yolo Pilates is not responsible or liable for any difficulties or consequences associated with downloading the software. Use of any downloaded software is governed by the terms of the license agreement, if any, which accompanies or is provided with the software.
